FORT PIERCE, Fla. — Former CIA Director John Brennan has been subpoenaed to testify next month before a federal grand jury in Fort Pierce as the Justice Department continues a wide-ranging investigation into whether former government officials conspired to violate President Donald Trump’s civil rights.

Brennan attorney Kenneth Wainstein disclosed the subpoena in a sworn court filing Monday. According to Wainstein, prosecutors presented the subpoena September 10, directing Brennan to appear before the Fort Pierce grand jury on October 15.

The subpoena relates to what Brennan’s attorney described as a “far-reaching” investigation based in Fort Pierce. Wainstein said prosecutor Kurt Olsen told Brennan’s legal team that multiple grand jury investigations remain active, including an inquiry involving “issues at Mar-a-Lago and beyond” and whether Trump’s civil rights were violated.

The broader investigation is examining actions by law-enforcement and intelligence officials who investigated Trump over the past decade, including matters involving Russian interference in the 2016 presidential election and the classified-documents investigation involving Trump’s Mar-a-Lago estate.

Brennan A Subject In Fort Pierce Probe

According to Wainstein, prosecutors have described Brennan as a “subject” of the broader Fort Pierce investigation. That designation does not mean Brennan has been charged with a crime.

Brennan remains a target of a separate Washington-based investigation into whether he made false statements to Congress in 2023 concerning the intelligence community’s assessment of Russian interference in the 2016 election. Brennan and his attorneys deny wrongdoing.

No criminal charges have been announced against Brennan in either investigation.

Brennan Challenges Investigation

The subpoena became public through Brennan’s lawsuit against the Trump administration. His attorneys are asking a federal court in Washington to require the government to preserve records connected to the investigations, arguing those materials could become relevant if Brennan is later prosecuted and challenges a case as selective or vindictive.

The Justice Department opposes the preservation request, arguing Brennan has not been charged and that the request is premature. U.S. District Judge Jia Cobb heard arguments Monday but did not immediately rule.

Investigation Continues After Prosecutor Resigns

The subpoena was issued the same day Joe diGenova, who had been overseeing the broader Florida investigation, resigned from the Justice Department.

Attorney General Todd Blanche said Tuesday that investigations previously overseen by diGenova will continue despite his departure. The Justice Department has not publicly announced criminal charges resulting from the broader inquiry.

National Investigation Lands In Fort Pierce

For Treasure Coast residents, the location of the grand jury gives the national investigation a direct local connection.

Fort Pierce is part of the Southern District of Florida, which also includes Palm Beach County and Mar-a-Lago. Brennan’s subpoena places proceedings connected to one of the Justice Department’s most closely watched investigations before a federal grand jury on the Treasure Coast.

Grand jury proceedings are generally secret, meaning much of the investigation may remain outside public view unless prosecutors seek indictments or related court proceedings become public.

Brennan is scheduled to appear before the Fort Pierce grand jury on October 15.
